Rental Terms:
GUNIMEK AB – Sweagro
Effective from: 2022-05-10 until further notice.
These general rental terms comprise five (5) pages and are based on the “General Rental Terms for Rental,” adopted by the Swedish Rental Association (SRA) and the Swedish Construction Federation (BI).
1.1 These general rental terms apply to the rental of equipment, construction machinery, and lifting devices without an operator. Amendments or additions to the rental terms require written form.
1.2 Specific terms apply for transport, assembly, and service when required.
2.1 The rental item may not be used in violation of these terms or in a manner that risks affecting the lessor’s ownership rights. The lessee may not alter identification marks, written instructions, or similar without written approval.
2.2 The lessee may not, without the lessor’s written consent, transfer the rental agreement or sublet the rental item to a third party.
2.3 The lessor reserves the right to replace the rental item with equivalent machinery during the rental period. The lessor shall notify the lessee at least two days in advance, except for rentals with a purchase option.
3.1 Rental items must be collected and returned to lessor’s depots/workshop or partners as agreed in written. Alternatively, the item should be transported to one of the lessor’s depots/workshop partners for inspection after the rental period. Following the inspection, a final invoice may be issued for any necessary repairs. If transport by the lessor is agreed upon, the rental item must be delivered to the designated location. The item is considered returned when collected by the lessor at the specified location.
3.2 Upon return, the rental item must be clean and in good condition, considering normal wear and tear. Otherwise, the lessor is entitled to perform necessary cleaning and repairs at the lessee’s expense.
4.1 The lessee is obligated to inspect the rental item immediately upon receipt and before use. Any defects or issues must be reported to the lessor within five days of the item being made available to the lessee. If no claim is made within this period, the item is considered received in good condition.
4.2 The lessor is responsible for mandatory inspections of the rental item. The lessor may conduct mandatory inspections at the worksite during regular working hours after providing notice.
5.1 The rental item may only be used for tasks and under conditions for which it is intended.
5.2 Only qualified and authorized personnel may operate the rental item. The lessee must ensure they receive handling and maintenance instructions upon collection and return of the item.
5.3 The rental item must be handled and stored by the lessee in a manner that prevents damage, unauthorized use, or theft.
6.1 The rental period begins on the agreed date when the rental item is made available for collection.
7.1 Rental fees are charged per rental occasion according to the lessor’s prevailing price list.
7.2 Additional fees, including cleaning, transport, or special services, will be invoiced separately unless otherwise agreed.
7.3 The agreed daily rental rate applies per item and day. Partial days are charged as full days.
8.1 The lessor is responsible for costs arising from normal wear and tear.
8.2 The lessee is liable for the loss of the item and damages beyond normal wear and tear.
9.1 Both the lessor and lessee must maintain standard liability insurance.
9.2 The lessee is responsible for deductibles and VAT in insurance claims.
10.1 Either party may terminate the agreement in the event of a material breach.
10.2 Non-payment allows the lessor to immediately terminate the agreement and reclaim the rental item.
11.1 Any purchase option is valid only if the rental agreement has otherwise been adhered to.
12.1 The lessor is the data controller and processes personal data in accordance with applicable laws.
12.2 The lessee consents to the lessor processing personal data for administrative purposes.
13.1 Disputes shall be resolved under Swedish law and in general courts unless arbitration is agreed.
14.1 Ownership of goods remains with the seller until full payment has been received.
15.1 If the lessee cannot be reached via the communication way that the order was placed via or provided email, phone, or mail regarding a return or purchase option decision after the rental period, the lessor assumes the lessee wishes to exercise the purchase option. An invoice for the purchase amount will then be issued as per the lessor’s current price list.
15.2 If the lessee does not wish to purchase the item, they must notify the lessor before the rental period ends. The lessor will arrange for return transport, typically prepaid as part of the standard agreement unless otherwise agreed. Additional costs beyond the prepaid amount are borne by the lessee.
15.3 In case of a dispute, the lessor may retrieve their property using alternative transportation methods, such as a crane truck or special transport. These costs are fully charged to the lessee. The lessee must prepare the item for transport and handle loading. If the item is retrieved in an unprepared state, incurring significantly increased costs, the difference will be invoiced to the lessee.
15.4 Acceptance of Terms by Payment: By paying the rental fee, the lessee agrees to the rental terms available on the website www.sweagro.com under “Terms.” The lessee is responsible for reviewing these terms before payment. These terms constitute a legally binding agreement.
